According to KPRC News, they also requested the construction of a privacy fence, but unfortunately this request was denied. HOA only allows wrought iron fences.
One of their neighbors has called the theater “a disgusting eye” and is suing them for $100,000 in alleged damages for allegedly understating the value of their properties.
No one should be surprised to learn that not only is the neighbor well aware of Colton’s plight, but this isn’t the first time he’s sued one of his neighbors. Kim Costa took to Facebook to speak out about this terrible situation and ask for help. I wrote,
“They’re asking for ‘compensation’. $100,000 in damages, so I come to ask you to pray.”
Their papers have been officially filed for legal action against their home in Georgetown, Texas. In addition, the neighbor indicated that it is not enough for him to have prior approval from the HOA to build the structure. No, the neighbor thinks he should have asked her permission first too.
You might think an acre would be big enough to do just about anything you wanted. You might think that just going past the HOA board for permission means you’re good. But no, apparently not.
Update: Kim Costa has updated her Facebook page to say the lawsuit has been dismissed. In a message, she wrote: “The lawsuit has been officially dismissed! (For now anyway!) Thank you all for your prayers and support!…who has ever heard of being sued for a stage show?
